Gears of war 3 freezing

i got gears of war last week when i was at my familys for the week for my birthday i now live 250 miles away from my family and when i got to my place gears froze constantly on the marcus fenix loading page.

i sent the game via recorded delivery so that they could get a new disc incase that was the problem, my new one came today and still have the same problem.

 

does anybody have and explination or suffering from the same problem and a possible solution ?

A round about way that was suggested to me is to load the game with no profile, load campaign with no profile, than as you see the movie load your profile, it resets you back to the start menu and lets you play for a bit. this does not correct the issue, but gives you brief play time till a real fix is out.
