Won't let me have this gamertag

Hello, well it depends, if the gamertag is original, for example like Space, most likely it would be taken by the original name and/or by a count of numbers behind it. The gamertag could also be used on Zune, so unfortunately you wouldn't be able to see if it is available if it's on Zune unless you go to the website. If you want the gamertag really bad, I suggest adding number(s) or extra letter(s) to it.

I would guess that it must be against the Code of Conduct somehow.

Don't create a gamertag, profile content, Avatar action, Avatar content, or in-game content that other users may be offended by. This includes, without limitation, anything related to or suggestive of: profane words/phrases, topics or content of a sexual nature, hate speech (including but not limited to racial, ethnic, or religious slurs), illegal drugs/controlled substances, or illegal activities.

Don't create a gamertag, profile content, Avatar action, Avatar content, or in-game content that references controversial religious topics, notorious people, organizations, or sensitive current or historical events that may be considered inappropriate.

I would just pick a different gametag. That way you know for sure your not breaking the rules.

Those two statements are conflicting. Let's say I decided I wanted to change my gamertag to "Militant Eight 1". If I type it in, ready to pay my 800 Points, my Xbox will say it is taken. But if I "check on Xbox Live" (however you did that), I won't find it because the one that's taken is actually MilitantEight1, with no spaces. The only way to know for sure if a gamertag you can't find on Live is available is to try to change to it, as you did in the first place.

(Unfortunately, I'm not sure Support would know enough to explain or check for this possibility, so I wouldn't take as certain their statement that your desired gamertag isn't taken.)

It's also possible your GT was taken by a Games for Windows Live user.

Doubtful, as GFWL and Xbox Live are the same thing, a GFWL gamertag will still show up the same way.
