how do i locate my laptop it was stolen

Hi,
If the device was signed into your Microsoft Account as a Windows User. Then you may be able to use the Fund My Device tool. It should allow you to locate and if you want erase the device remotely. It is worth noting though that if they swapped out your hard drive there is not much you can do. Since this relies on it being turned on with your install.

yes i dont know if they took the hard drive out or if the reset it to factory setting but it was dead for sure so they would have to unlock my account but the issue reamains  about the hard drive swap... i have the orgibal box that it came in and the serial number of the laptop its self... was hoping microsoft could help me track it through the serial number .... thats something that microsft collects and i was thinking if they did do a hard drive sway they couldnt swap the serial number right...

No. This is not something they collect or use for this. It wouldn't work anyway, you would still need to device to be registered to the account. The way it works is if find my device is enabled it periodically uploads the location of your devices on the account. But as I said that requires them to be turned on and on your account. The best you can without that is report the theft to the police but there's nothing else built in to Windows that I know of or can find to solve this with.
