Want me to pay again and download history doesn't work

I purchased The elder scrolls oblivion over xbox live some time ago and now when i try to download it again it wants me to purchase it again. Even if I try to download it from my download history it comes up with an error.

What is the error you get when you try to redownload?  Also, did you try to access your download history from the console or from the download link on the forums here?

I downloaded it from the console, and maybe error is the wrong word, it just goes immediately into my memory as a incomplete download with the yellow Exclamation point.

Did you happen to change your region for your Xbox Live account when Microsoft made that option available. Some download/content was not included in the migration process and it could be that Oblivion was one of those items that wasn't included in the transfer process.

Delete the download, clear the cache and restart the console.  Try the download again.

If that doesn't work, go to Social>Sign In/Out>Download Profile and redownload your profile (no need to delete it first) then follow the instructions above again.
