Getting replacement HTC 8x to work with my ms account with music pass

I recently broke my HTC 8x phone and had to go to the store and to get a replacement 8x.  With the new HTC 8x, even though I've configured all the ms account info with the appropriate credentials, I only get the option to buy music from the music store and no longer getting the download option.  I have confirmed that I have the music pass service and that my service is paid up through 12/2013. 

In troubleshooting, I went through the "My Account" option under my live ID and deleted the old devices from my music pass account.  I am still unable to get the new device to download music from the store without getting the option to buy from ATT. 

Is this a known issue?
