Firstly, make sure that it's not the disc. Try playing it on another disc, or try using your disc on another console. If you're sure that it's not the disc then the solution could be as simple as re-updating your game.
To do this press the guide button, go to the Settings blade, go to System Settings and then Storage. Then highlight your main storage device and press Y. There will be an option to clear System Cache, which will remove ALL updates stored on that device,
select it. The next time you go onto Gears of War 2 you will be asked to update the game.
Microsoft are not responsible for patching games, this is the sole responsibility of the developer.
