Why did you bought it when you knew it was damaged? Return the game have them give you a good copy with no damage. Not too hard to figure that one out is it.
I had an experience once where I wasn't able to return it. I had in-store reserved Mass Effect 2: Collectors' Edition at Best Buy the morning of launch, and went to pick it up after work. I was lucky as it was the last copy they had, and had I not reserved
it, they would have been out.
I got home and opened it up only to find the plastic inner-casing of the limited edition SteelBook case cracked in some parts and missing plastic (it had broken off) in other parts.
I took it back to see about an exchange, but of course since they had no more, they couldn't. The clerk offered to swap me out with the PC version's casing (since they're the same), but when he checked they were out of that too.
So I had the choice of returning it and not having the Collectors' Edition or sucking it up and keeping it. I decided on the latter, as the actual damage to the case wasn't the end of the world, but it was disappointing.
On a related topic, that's the most limited Collectors' Edition I've seen for a game in many years. I check when I got back home and various store chains all over the GTA were sold out already, in less than 24 hours.
