yeah sounds like the previous owner had one of the Entertainment for All plans that gave him/her a 99 dollar 360 but they had to sign up for a 2 year contract to pay the gold account for those 2 years. that user probably wiped the drive and traded it in
and you got stuck with it. Smwutches is correct you will have to take it up with the place you got it from, good luck.
