Console may be used?

I recently bought a Xbox 360 Slim 250GB, i received it in a other box than de original 360 should came in, it was the Forza 3 & Crysis pack but without the games itself.

So i thought, it could be used already? Sometimes i have FPS lag in Alan Wake (my first bought game) so i can't test it with other games and when i'm at 1080p the guide menu text, is kind of aliased while the rest is just normal (tested it on 3 full hd screens).

On my old Xbox the Console id was showing on the back of the chassis, but here only a serial number, manufacture date (which is 2011-08-30).

The XBox was starting up with its "Configure your new xbox 360 console" etc... with creating account and stuff like that.

So could it be used?

Whether it has been used by another person or possibly a display model for the store you bought it from, there is no reason it should not be in the correct packaging.
There is absolutely no valid reason (that I can think of) for the store to have removed it from the packaging it would have come in when the unit arrived in store from the suppliers.

Even if the console was not showing any issues I would take it back immediately regardless.
Others may think differently but that's my advice.

Yes that is unacceptable, no retail store or wherever you got it from should have it packaged like it was already opened, for the price you pay for there should be no doubts in your mind.  You have 30 days so return it immediately and either get it from the same place or purchase it from another source.
