20gb HDD in S-models console

Hi Guys! I have a question... You get banned for use a 20gb FAT hdd in a 4gb Slim? Its possible and I saw how do it, but I dont wanna get banned... It works fine! My friend do it in his Slim... I know that the ToU says: A hardware modification ban you from Live, but this is not a "modifcation" I only re-use a OFICIAL product of Microsoft... Why they say that ban you? You dont modificate the Slim console for make the Fat hdd works.. You only disarm the FAT hdd, and take out the HDD, the FAT Hdd and Slim hdd is the same, the difference is the case... All the xbox HDD is a 2.5" laptop SATA Hard drive (comprobed by me and my friend) You don't modificate the HDD for make it works with the slim... You only take out the case and put in the Slim... You don't add anithyng to the Hdd, same with the Slim... I don't gona buy the 250GB Slim HDD is very expensive and unnecesary, I don't have money for buy it, in my country the oficial 250HDD costs the half of a 4gb Slim... My Fat xbox gets Red Lights and i don't gona buy another HDD pr a transfer cable I know that you lose the Hard Drive Warranty, but I have 3 years with that HDD, I dont have Warranty any more...Just tell me, they ban you? YES OR NO? I called to xbox support but dont give me a solid answer... Thanks

yes its against the terms of use to modify an offical ms product

Removing the old HDDs from their casing, for use in a 360 S console or other reason, is against the Xbox LIVE Terms of Use, hardware tampering and modification. Modifying your hardware can lead to LIVE account suspensions and/or console bans.

In addition, discussion of this subject on the forums is against our Xbox LIVE Code of Conduct, and as such may result in a suspension or ban from the forums or the Xbox LIVE service itself.

From the Terms of Use:

12.  Service Operation and Equipment.

Any attempt to disassemble, decompile, create derivative works of, reverse engineer, modify, further sublicense, distribute, or use for other purposes the Service, any game, application, or other content available or accessible through the Service, or any hardware or software associated with the Service or with an original Xbox or Xbox 360 console is strictly prohibited and may result in cancellation of your account and/or your ability to access the Service, and the pursuit of other legal remedies by Microsoft.  Microsoft may take any legal action it deems appropriate against users who violate Microsoft's systems or network security, this contract or any additional terms incorporated or referenced in this contract, and such users may also incur criminal or civil liability.

Disassemble it is a modification? Ok it's over, I'm gonna sell my 360 and buy a PS3, Free internet, You can use third-party hard drives.. I'm tired of this things, first my Fat xbox gets the RRoD and then this..

PS3 , might be free but their customer services is not so great.  At least with Xbox customer service you get treated right and no massive security breaches.
