Xbox 360 Console Ban Question

My console isn't banned however the disc tray doesn't read. I don't want to spend alot of money so I am buying a refurbished. However if the previous owner gets the console banned while I log on my account would that also ban my account?

no bans are only on the console if he gets say banned it will not ban your account cause your account would be on the new console.

If the disc tray doesn't read, that's definitely not a ban; it's a hardware issue. Refer to support.xbox.com/.../disc-drive-solution to try to fix this problem.
