Pre modified controlers = ban?

Are we (xbox users) aloud to buy/use rappid fire controlers

I would think they would break the terms of use (SECTION 14)

" your software and hardware have not been modified in any unauthorized way  (e.g., through unauthorized repairs, unauthorized upgrades, or unauthorized downloads);  "

And the obvious

" Don't cheat in a game unless cheats have been deliberately enabled. "

however Gamestop Target and Amazon are selling the "turbofire 2" and similar controlers that give you a "Unfair Atvantage"

Is/has Microsoft planning to contact these sellers to advise them they might be selling ban-worthy hardware
however Gamestop Target and Amazon are selling the "turbofire 2" and similar controlers that give you a "Unfair Atvantage"
You need to remember that it's those stores (and others) job to sell a product.  To make money off that product.  They have no interest in any end user license agreement between us and Microsoft.  Provided the product isn't illegal, they can sell whatever they want.  It's up to us to decide whether to buy it and risk the consequences, or leave it on the store shelf.

Licensed controllers, like those from Madcatz, are acceptable.

Unlicensed controllers (like those from Datel) are not.

Microsoft has made a stand that they are not going to ban ppl for modded controllers

BUT the publishers' still can Bungie/343/Activision etc..

I do not personal use them, and they are annoying to meet in games and get reported.

Sorry your FNL does not fire like an automatic.
Microsoft has made a stand that they are not going to ban ppl for modded controllers
That's not what they've said. Licensed controllers with extra features, like auto-fire, turbo modes, etc, are permitted on the Service as they are licensed accessories. Game studios have to take into account that people may buy said controllers and adapt their games to function with them (as in, if the devs do not like auto fire the game has to block it from happening).

Unlicensed modded controllers are not permitted on the service.
Yes I was taking into account they were licensed controllers
Let's re-read what you just posted:
Microsoft has made a stand that they are not going to ban ppl for modded controllers
Stepto has never directly stated that unlicensed controllers will not result in a ban of some sort.

Go listen to show #331, the one from PAX 2009. 52:00 to 57:10. He never says it's not banned, he tells the question asker to see him after the show. He also never says modded controllers won't result in a ban in the clip you posted.

If it's a licensed device, it's fine. If it is not, don't use it. Datel's controllers are not licensed. Anything that requires you to open the controller (which is most unlicensed modded controllers) is against the Terms of Use.
Let me add to this by bursting a MASSIVE misconception of that video.  It's title is "Modded Controller are Legal on Xbox Live."  Not only is it a patently false statement.  It is a completely misleading statement.

The base their theory on the legality of "modded" controls on Stepto's statement about "Turbo" in that podcast excerpt.  The flaw in their theory is Stepto never ONCE said that "modded" controller are allowed.  This is because they are NOT ALLOWED.

"Turbo" controllers ≠ "Modded" controllers.  This is where the entire misconception is.

A "Turbo" controller is something that has been designed, and manufactured brand new as a controller that has "Turbo" functionality.  Provided the controller is a licensed product, it is permitted on Xbox Live.

"Modded" controller, however are a completely different animal.  They are existing controller that have opened up in order to alter (modify) the functionality of the controller to something other than the original specifications.  This is, never was, never will be allowed, and is a violation of sec 14 of the ToU.
